Abstract In this paper, we examined the situation of accepting foreign labor after the enforcement of SWP in Korea. The Employment Permit System (EPS) was based on full-year employment and couldn’t cope with t...he fluctuations of agricultural employment. Although SWP relieved the seasonal fluctuations, it couldn’t flexibly respond to labor demand due to requirements for immigration in a group. In addition, since they couldn’t cover temporary employment demand during the busy season, it incited illegal employment.\ In order to reduce illegal employment, it was necessary to respond to the temporary short-term employment demand. It is difficult to solve this short-term employment problem. Especially in aging rural areas, labor shortages are chronic and farming is impossible without foreign labor. Farm management heavily depends on the foreign labor, thus strict crackdown on illegal employment makes farm management unstable. Farmers employ foreigners, knowing they are illegal. In order to normalize illegal employment, it will be need a rigorous analysis of employment demand in agriculture and restructuring of the system to meet employment demand, but this will not be easy.show more
