Abstract This paper analyzes one of the most important rules of copyright law relating to the produce of entertainment stories -the idea/expression dichotomy. This rule means that copyright law protects the ex...pression of ideas, not the ideas themselves. That is, copyright law does not preclude others from using the ideas revealed by the author's work.
The line between idea and expression, however, is rarely an easy one to draw. At stake is whether the copyright monopoly will extend too far and stifle creativity by preventing later artists from making use of ideas that came before them. Of particular concern is whether copyright precludes use of dramatic and memorable scenes and characters in later stories whose overall themes and feel are quite different
This paper attempts to clarify how to prevent this intellectual stagnation by comparing various legal tests expressed by the courts in some critical cases in the context of the idea/expression divide
