On the Actual Condition of Compensation for the Forest Reserves and Natural Green Areas Protected by Law in Urban Areas

Abstract 都市,すなわち人口集中地区の環境の保全と自然環境そのものの保全は,現在,開発に対する法的規制に依拠して進められている.しかし,法的規制は私的所有権を侵害するため,規制による損失に対して補償を行っている.このような措置が社会的にとられているにもかかわらず,現在でも環境保全が進んでいるとはいえない.そこで,損失補償の実態を都市緑地保全法による緑地保全地区と森林法による保安林について分析した.前者は,福...岡市,北九州市の緑地保全地区,後者は,福岡県,長崎県の保安林の補償状況を調べた.指定された緑地保全地区は補償よりも買い入れている.保安林の損失補償は福岡県で年間約2,200万円,長崎県で138万円であった.今後,科学的な損失補償の在り方の考究と森林・緑地の保全に関わる諸法律の改善と再編が課題といえる.
Some laws can restrain development of forests and natural green areas to protect human life against damage, disaster and sprawl of town. The national government and local governments compensate the owners of forest reserves and natural green areas protected by law. This paper analyzes the actual conditions of compensation for natural green areas offered by two local governments, Fukuolka city and Kitakyushu city, and compensation for forest reserves offered by the two prefectural governments, Fukuoka prefecture and Nagasaki prefecture. The results are sammarized as follows; 1) there are natural green areas protected by coservation law of natural green area in urban area ; 87.9 ha, in Fukuoka city district and 73.6ha, in Kitakyushu city district. 2) Fukuoka city office and Kitakyushu city office are buying the natural green areas instead of compensation. 3) The local government of Fukuoka prefecture provides compensation of ¥21 million for the year, 1993, to owners of forest reserves ; 368ha, and the local govornment of Nagasaki prefecture provides ¥1.38 million for the year, 1993, to owners of forest reserves ; 60ha. The expansion of natural green area protected by law is difficult due to the limited budget of national government and local governments. Therefore, it is hoped that law restricts severely cutting trees in all forests and natural green areas and other land in future. Now, the Forest Agency has plan to increase forest reserves for recreation. The owners of forest reserves for recreation need greater cash subsidies as compensation for management costs.
