概要 Ali (religion, Boston U.) offers a lucid discussion of the creation of laws governing marriage in the first two centuries of the Islamic world, describing how laws for slaves are consistently adapted ...o create laws over wives. The parallels between wife and slave, husband and master, which continue to operate in present-day Islamic law, are traced in the writings of Malik ibn Anas, Abu Hanifa, and Muhammad ibn Idris al-Shafi'i and their schools. Anything but dry, the text includes the stories of the cases, the response of the jurists, and the implications for those concerned, whether slave, wife, owner, or husband. The differences in interpretation of the legal schools are discussed as each aspect of marriage, including the initial transaction, divorce, wive's rights to companionship, the husband's rights to sexual relations, fairness towards multiple wives, and the husband's dominion, is explored. This is a significant contribution to the scholarship of women in Islam as well as early Islamic society and its laws. Annotation ©2011 Book News, Inc., Portland, OR (booknews.com) 続きを見る
