| 概要 | In preparing this research handbook on the theory and history of international law, editor Orakhelashvili (U. of Birmingham, England) has sought to "focus on the most durable elements of international...legal theory and to ensure the proper representation of those theories and issues that [have] been demonstrated through long experience." He presents 17 chapters in three sections. The first addresses the essential elements and development of international legal theory and includes discussions of early-modern scholarship on international law, natural law and the law of nations, the origins of consensual positivism, and the contributions of key figures such as Hans Kelsen and Philip Allott. The second is devoted to thematic aspects and discusses international human rights law theory, international criminal law, international law and European Union law, and the relationship between international law and international politics and ideology.
