| 概要 | The law ofunjust enrichment is of central importance for all areas of civil law -and beyond, if we consider the repercussions on reimbursement claims under public law. Complex issues such as intricat... triangular transactions as well as the uncertain content of a claim of unjustified enrichment are systematically and clearly explained. Where appropriate, the author develops new and balanced solutions. New rulings and important publications are extensively analysed in the relevant context. The 2002 edition was oriented in particular to decisions from the Federal High Court (Bundesgerichtshof) on official and state liability law and itself provided important impulses to the latest judicial decisions. The present revised edition continues consistently on this tried and tested path. The commentary on A839a on the liability of the court expert witness was completely revised and substantially extended and deepened. The revision takes account of the development of the law in the last five years, in particular the court decisions following the transition from sections 636 ff. of the Insurance Regulations to sections 104 ff. of the Social Security Code Book VII, which have led, among other things, to a refining of the solution approaches for a oeincomplete joint and several liabilitya .
