概要 | Once again advances in technology ran roughshod over existing law, as the move to digital technology made mincemeat of Article 52 of the European Patent Convention. In response, the European Patent Or...anizations created the concept of "technical effect," which stated that protection should be available for a device. This concept has protected both software and business methods when courts and other policy makers accept the form of application rather than the substance, but another result is increasing difficulty in protecting inventive activity in software. Leith (law, Queen's U., Belfast) considers whether software is a "machine" or software, comments on policy arguments, analyzes how software patents are born and examined, evaluates the current algorithms and business methods, considers a solution somewhere between patent and copyright, and describes how to deal with new technologies.
