| 概要 | Senftleben (U. of Karlsruhe) specializes in the development of copyright law in the emerging information society. He notes that the formula consisting of three abstract criteria crept into internation...l copyright law outside the attention of most analysts and has not become entrenched. Its fundamental problem, he says, is that it is a delicate balance between grants and reservations of copyright, and from a functional perspective sets limits to limitations of exclusive rights. In his synthetic approach, he regards and treats the three-step test as one uniform instrument of international law, and the different provisions as limbs of that unitary body adding different connotations and assigning different functions to the test that must be analyzed in detail.
