| 概要 | Since modern antitrust law emerged over a century ago, explains Kallay (law, Bar Ilan U., Israel), scholars and courts have been baffled by the rise of many tensions between intellectual property laws...and nascent antitrust laws. She contributes to the ongoing study and reconciliation attempts, discussing a framework for analyzing the intersection between the two law systems, the Austrian economics solution and the property narrative, the dynamic antitrust analysis model, and applying the dynamic model on refusal to license intellectual property and in network industries. Case studies for the last two are Magill and Dell. The study is a revision of her doctoral dissertation for the University of Michigan.
