Crofts (Murdoch...U. School of Law, Australia) comparatively examines the historical development and current presumptions of the legal formulations of criminal responsibility. Each legal system is accorded separate section that proceed along similar lines, discussing what basis was used for the fixing of ages of criminal responsibility, the factors that are legally taken to establish criminal responsibility, and criticisms aimed at both systems. Finally he makes recommendations for the English system, in which the application of punitive measures would be separated from non-punitive measures, with the application of punishment requiring proof of criminal responsibility.
