概要 Based on a November 1999 workshop held at the European University Institute in Florence, eight papers, mostly written by law professors, focus on the growing impact of European law on the core element... of EU member states' administrative law, and especially on their different conceptions of procedure. A study of the British legal system highlights the tendency of European law to bypass the stores of experience and practical orientation patterns contained in legal systems without replacing them with anything of equal value. The French are seen as incorporating a conception of cost-benefit analysis into their legal system. Dutch law is used to investigate the problems arising in using the "effet utile" formula to link European and national law. Other issues include the adjustment problems of Italian law, German neglect of autonomy of procedure, and British environmental case law. Annotation copyrighted by Book News, Inc., Portland, OR続きを見る
