| 概要 | Entries in this encyclopedia have two elements: a review of the literature, written by an authority in the field, and a quasi-complete bibliography. The reviews of the literature are on average nearly...10,000 words in which the basic questions and items of discussion are explained, the literature summarized, the critical reflections on these publications and on the evolution of the discussion in general developed, and suggestions for further research made. Surveys are not overly technical in order to be accessible to non-specialists like judges, politicians, or undergraduates. Bibliographies list, in total, 20,000 law and economics publications, often difficult to find in one location. Topics are divided into substantial norms and meta-norms. Substantial norms are divided into property and its transfer, voluntary transfer of property between private parties, and involuntary transfers between citizens and the state. Meta-norms include litigation and evidence law, criminal law, and rules on the production of legal rules. This volume's special classification system can improve analyses by suggesting what kind of models are to be applied. Medical malpractice, for instance, is considered by Anglo- Americans as a branch of tort law, but, say the editors, it is more correct from an economic viewpoint to consider malpractice as a regulation of contracts between patients and physicians. Again, marriage law is, according to many legal systems, part of family law, but here it is seen as the regulation of a specific contract. The book is interestingly introduced with bibliographical lists of introductory books and articles, monographs, book reviews, symposia, new articles, readers, doctoral and master's theses, and other introductions.
