This volume of the Yearbook breaks ground by expanding its coverage in several ways. The scope of these new developments includes the following: . The Yearbook's thorough coverage, the first-time enhancements in this issue, & the wealth of recent developments in the field make this issue of the Yearbook a must-read for the practitioner. The twenty-third volume is the most extensive of this long-standing series edited by Professor Albert Jan van den Berg, comprising 1306 pages of worldwide, up-to-date information on international commercial arbitration. The extensive contents reflect the ever-expanding & changing law & practice of arbitration. Yearbook Commercial Arbitration is the sister publication of the International Handbook on Commercial Arbitration, both published under the auspices of the International Council for Commercial Arbitration with the assistance of the International Bureau of the Permanent Court of Arbitration. Part I of the Yearbook reproduces the Table of Contents of the Handbook providing an overview of the more than 60 national reports & arbitration legislation included in this related publication. The Yearbook publishes extensive excerpts of arbitral awards made under the auspices of the International Court of Arbitration of the International Chamber of Commerce, the Iran-US Claims Tribunal & other international arbitral institutions. The new or amended Rules o feight arbitral institutions centered in Europe, North Africa & the Pacific Rim are also reproduced. Recent developments are tracked in the form of excerpts of leading court decisions from Austria, Egypt, The Court of Justice of the European Communities, The Netherlands, Switzerland & the USA. These court decisions deal with a broad variety of matters including the arbitrability of administrative contracts under Egyptian law, the levying of turnover taxon European arbitrators' fees, & expanded review by a court of an arbitration award. The Yearbook also reproduces the portions of UNCITRAL's CLOUT containing summaries of court decisions applying the UNCITRAL Model Law on International Commercial Arbitration & supplements this with a cumulative index of articles of the Model Law. Other aspects of recent developments are reported in Part IV which summarizes new arbitration legislation in Egypt, Germany, Iran, Lithuania, Oman & Peru. Part V-A focuses on the 1958 New York Convention which this year celebrated its 40th anniversary. This Part contains 59 decisions from 15 countries bringing the total of New York Convention cases reported in the Yearbook to 787 cases from 44 countries. The approximately 800 cases represent the most extensive published documentation on the New York Convention. In Part VI an earlier tradition of publishing articles is revived. An article by R. Doak Bishop entitled 'International Arbitration of Petroleum Disputes: The Development of a Lex Petrolea' surveys virtually all published arbitral awards relating to the petroleum industry, & distills from them 'a comprehensive roadmap' of the issues & solutions found in these awards. The Yearbook concludes with an extensive Bibliography & List of Arbitration Journals. The many & varied recent developments in the field of international commercial arbitration are once again brought together in this Volume of Yearbook Commercial Arbitration. As in previous volumes, the accent lies on cases in the form of arbitral awards & court decisions, 80 in total. They are selected for inclusion for their general interest & relevance to international practice, presented in a uniform style & translated into English from Arabic, Dutch, French, German, Italian, Japanese, Russian, Swedish & Spanish, as the case may be. The selection of arbitral awards covers a broad spectrum of commercial sectors: finance, maritime, commodities & manufacturing, as well as a variety of contract types such as consultancy, distributorship, foreign investment & sales. The awards also examine many aspects of procedure such as assignment & succession, jurisdiction, determination of the applicable law (including lex mercatoria), interim measures & the powers of arbitrators. ICSID, ICC & Iran-US Claims Tribunal awards are included as well as awards from German, Italian, Japanese & Russian arbitral institutions. The North American Free Trade Agreement (NAFTA) has a place in the Yearbook for the first time in the form of a Decision on the place of arbitration & Award on jurisdiction by an ad hoc tribunal constituted under this Agreement & applying the UNCITRAL Rules. Prominence is given to the reporting on the 1958 New York Convention where 42 decisions from 15 jurisdictions comprising 13 countries, the Court of Justice of the European Communities & the Full Tribunal of the Iran-US Claims Tribunal are included. Common themes are the requirement of an arbitration agreement in writing, the binding effect of arbitral awards, the role of EU procedural & substantive law in arbitration, procedural flaws in the arbitration which may constitute a violation of public policy, sovereign immunity, & the balance of interests between finality of awards & the illegality of the underlying contract. Several decisions applying the 1961 European Convention & the 1975 Panama Convention are also published. The Yearbook additionally publishes a selection of leading court decisions from various countries which will impact arbitration practice in general. This year's selection includes decisions from 8 countries & the Court of Justice of the European Communities on such topics as interim measures, the role of EU law, confidentiality, public policy & illegality, & 'unconscionable' arbitral clauses. Other features of the Yearbook are the newest rules from the American Arbitration Association (AAA), the China International Economic & Trade Arbitration Commission (CIETAC) & the Stockholm Chamber of Commerce (SCC) & the recently amended Supplementary Rules Governing the Taking of Evidence in International Commercial Arbitration of the International Bar Association with an Introduction by David Rivkin. New or amended arbitration legislation is announced in Recent Developments in Arbitration Law & Practice, with references to the Yearbook's sister publication, the International Handbook on Commercial Arbitration, where the full text of the legislation will be published in English, along with a National Report setting out the law & practice of arbitration in that country. The Yearbook also provides a Bibliography, listing journals & announcing the newest publications in the field of arbitration, including ADR.
